Not every inherited California home requires a full probate proceeding. Whether probate is needed depends on title, estate planning, the identity of surviving owners, available transfer procedures, estate value, and other legal facts.

When might probate be unnecessary?

A different transfer process may be possible when property was held:

  • In a valid living trust
  • With an effective right of survivorship
  • Through a qualifying beneficiary arrangement
  • By an entity that continues after death
  • In an estate eligible for another California transfer procedure

These possibilities are not automatic. Documents and eligibility must be reviewed.

Can the family choose to skip probate?

No. Families cannot avoid legally required procedures merely by agreeing among themselves. A private agreement also may not eliminate creditor rights, tax obligations, title requirements, or the interests of missing or minor beneficiaries.
