California real estate withholding is a system for collecting a potential California income-tax payment from certain real property transfers. It is generally reported through California Form 593.

Is withholding the seller's final tax?

No. The amount withheld is not necessarily the final tax liability. Sellers generally claim the withholding as allowed when filing the applicable California return.

How may withholding be calculated?

When no exemption applies, current California procedures may permit a sales-price method or an alternative calculation based on estimated gain and the seller's filing classification. Requirements and rates can change, so the current Form 593 and instructions must be used.

Who can qualify for an exemption?

Form 593 includes certifications for circumstances such as certain principal-residence sales, zero-gain or loss transactions, qualifying exchanges, and specified entities or transfers. A seller must not claim an exemption without meeting its requirements.
